TERMS & CONDITIONS

These terms and conditions (the “Terms”) form the agreement between you, the parent/legal guardian (the “client”), and Sally Whitear, trading as, Once Upon A Time With Waggles (the “Provider”) for the provision of activity services to you and your child(ren) in the United Kingdom. By booking a session you agree to be bound by these Terms.

1. Services Provided and Booking

1.1 The provider agrees to offer storytime and educational activities in return for the agreed fees.
1.2 Sessions will be held at the locations and time and date detailed on the website and specified in your booking confirmation.
1.3 A booking is confirmed only upon receipt of full payment and the Provider’s confirmation email.

2. Client obligations and Parental Responsibility

2.1 Supervision: During all sessions the parent/legal guardian/carer in attendance is responsible for the direct supervision of their child/ren at all times. The provider’s staff are facilitators of the activities, not childcare providers in a supervisory capacity during these sessions.
2.2 Information provision: You must provide accurate and up-to-date information regarding your child, including any allergies, medical conditions, health problems, special educational needs/disabilities (SEND), dietary requirements. This information is critical for safety and must be updated immediately if changes occur. Send details via email to info@onceuponatimewithwaggles.co.uk.
2.3 Suitability: You must ensure your child is dressed appropriately for the activities. The Provider reserves the right to refuse participation if clothing is deemed unsafe or unsuitable.
2.4 Behaviour: You, your child(ren), your family members and anyone attending the sessions must not engage in any physical or verbal abuse or threats towards staff or other clients/attendees. The Provider operates a zero-tolerance policy for abuse. Unacceptable behaviour may result in immediate termination of the agreement and permanent removal from the premises/sessions without refund.

3. Payment, Cancellations and Refunds

3.1 Payment: Full payment is required in advance to secure a booking. Payment must be made by credit/debit card when booking a session via the website.
3.2 Cancellation by Client: If you cancel a session or block booking, you must provide at least 14 days written notice, in this case the provider will allocate a space on the next available session. Cancellations with less notice will not typically be allocated a replacement session.
3.3 Cancellations by Provider: The Provider reserves the right to cancel sessions due to unforeseen circumstances (e.g., extreme weather conditions, staff illness, facilities issues). In such cases, the Provider will attempt to reschedule the session or provide a refund/credit for the missed session/s. The Provider does not accept any legal responsibility for closures outside of the refund/credit for the session fee itself.

4. Health, Safety and Safeguarding

4.1 Safeguarding: All staff hold a current enhanced Disclosure and Barring Service (DBS) Check.
4.2 First Aid: All sessions have at least one first aid trained member of staff present. By agreeing to these terms, you consent to the Provider administering basic first aid to your child if required, using all reasonable care.
4.3 Liability and Duty of Care: The provider maintains appropriate Public Liability Insurance Cover. Participation for you and your child is at your own risk. The Provider does not accept liability for personal injury, or damage to/loss of personal property sustained during a session, provided we have not been negligent in our duty of care or breached a statutory duty.

5. Data Protection and Use of Information

5.1 Confidentiality: The provider is committed to protecting your privacy. We will retain and process the information you provide about yourself and your child in accordance with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018. We only use this information for the purposes of providing our services and ensuring the safety and well being of your child.
5.2 Storage: Personal data is stored securely (electronically with password protection or in a locked container for paper copies) and access is restricted to essential personnel only.
5.3 Photography: Any photographs or videos of your child used for publicity, including social media, will be edited to have the face covered to ensure your child is not recognisable. We will not use any photographs or videos for publicity or on our website, with your child’s face showing, without your explicit written consent, which can be withdrawn at any time.
